Question about tune posting

I want to post a variation of a tune - Around the Horn by Jay Ungar. It is under copyright. Since it is already on this site, can I post a variation and also do I need to get direct permission from Mr. Ungar? If so, does anyone have any idea of how to contact him?

Always good to ask permission first. Jay Ungar does receive royalties for sales of sheet music of his tunes. Fair play.

If he allows it, post the variation in the comments section, not as a new and separate tune.

What's the world coming to!? Excuse my ignorance but is this a trad tune in meaning of Irish trad? I looked at the tune list on the only recording it's credited too http://www.thesession.org/recordings/display/2373
and they don't look very trad to me but hey, I stand to be corrected!

If it's not Irish trad., then the simplest thing to do is to delete the tune off the database here and problem solved :)

Jay Unger already knows that several of his tunes are on site here and all he asks is that they be credited. If you have a 'variation', the practice is to add the ABCs for any different takes on a tune to the 'comments' of that tune...

People don't seem to quite get this whole copyright thing. The purpose of copyright is that the creator of something gets a slice of the takings whenever his/her creation is used by someone else to make money. And also so that someone else can't take credit for something they didn't create, but that also boils down to money, essentially.
So what I'm getting at is that if money doesn't come into the question - like when you submit a tune on this website - then nor does copyright. If you wanted to record one of Jay Ungar's tunes on a commercial recording, THEN you would have to ask about the copyright. Until then it's just common politeness, which has no hard and fast rules. It would be nice, in fact it would be the done thing, to mention the composer's name in the comments section. This should be so obvious that it's left unsaid, really. So there's no need to get your knickers in a twist about legalities unless you actually want to sell a recording of it.

Joe, that's ***not*** how copyright works.

Copyright prohibits the reproduction or distribution, in any format, of a work under copyright, without permission, except for personal use.

The salient point here is that if people can find Jay Ungar's tunes for free on this site, then they'll be disinclined to purchase the sheet music that Jay collects royalties on.

The posting here of copyrighted tunes without permission would be an infringement of copyright, and the poster (and Jeremy) could easily be sued. It may not be likely in many cases, but some copyright holders are diligent and persnickety (that's a fancy legal term) about it.

Besides, it's just common courtesy to ask permission first, and to NOT post the tune if permission isn't granted. Cases in point: John McCusker gladly gave me permission to post a tune of his here. But Win Horan did not respond to my queries about posting a tune of hers. So instead of posting it, I emailed it to the two or three people who wanted the dots for personal use.

I'll pipe in with my support of always asking permission : a tune of mine was printed in the Seattle book , Smoke In Your Eyes , and a "heads-up" would have been all I asked . I would prefer this site be used for Celtic traditional tunes and a separate site could be created by someone satisfying the contra-dance/Quebec/oldttime appetite ( Around the Horn , is a popular contra-dance tune )
