Video Cameras at Concerts

In another thread it's been claimed that maybe 'a lot of people are turning up with video cameras at concerts'.
If so, this is just a gentle reminder to everyone that it's illegal to record such performances by this or other mechanical means without the various permissions. But you all know that anyway.

Yes Mick, it's just that as in other areas technology has overtaken legislation in a way the legislators could not have foreseen. Until relatively recently a video camera was a very obvious object that would immediately attract the attention of concert hall stewards. Now we have the new breed of very inconspicuous mobile phones (cellphones in the US) with video recording capabilities, and how they are going to be policed effectively (or whether it's even worth policing them) by organisers is anyone's guess. Whether a particular performer or band is going to object to being videoed is one thing, but concert venues often have their own rules that apply to everything, regardless.
I don't know about live concerts but the film industry is taking a very hard line with people who make illegal videos of film showings at cinemas, but this is a situation where £$millions of revenue could be at stake. Money talks.

If they made a video camera the size of a lighter, and it could still produce a flame out of the top, you could probably get away with it. As long as you didn't mind a film of the lighter/camera's flame in front of you.

I guess we are talking about my thread...........and I agree with Fred ..........................but please also understand that most of the people that record concerts by audio or video are usually genuine fans. This means that they have bought ALL their commercial recordings and DO NOT MAKE MONEY from these concert recordings.

YES, there are a few scumbags out there that make money from it and this is DISGUSTING! and I am VERY against this practise !

BUT, BUT, BUT there are many concerts being released now that were at one time recorded illegally. The recent Christy Moore Box set of 6 cd's covering his very early solo, performances, Planxty recordings were MOSTLY made up from audience, and fan recordings. It is a GREAT collection of songs, recordings, and very rare performances and NOW a LEGAL release. Isn't that a great feeling that the fans can give something back to the artists !!!

I see alot of these Artists very important to the progession and development of the music around us, some of these people are pioneers of the craft and it is a shame that old radio recordings, interviews and solo performances should sit in a drawer or cupboard and never see the light of day !

If you have a recording, I would love to hear it !

I'd be interested to hear from the artists if they agree with you - I'm open minded and they just might.

However, as it stands, your admittedly sincere viewpoint would still put you on the wrong side of the law for the recording and would land you in deeper trouble for 'file sharing' on the net regardless of the lack of financial gain.I do understand your argument and to an extent sympathise, but these are the facts.

I genuinely hope you don't have to present your understanding of the legislation in front of a magistrate/judge!

If I was contacted by the Artist and asked to stop ' collecting' them, then I WOULD DO SO with no arguement or bitter feelings at all !

I know you would but that's the wrong way round! If you ask for the permission first and get it then all's hunky-dory!

In case i've given the wrong impression I'm actually on your side here and am not a kill-joy. I've been thwarted in a similar area of copyright control even though my action would not have deprived any one of a single penny.
Because it's impossible to control an illegal recording once it gets out the law takes the straight forward stance that ALL recordings done without permission are Illegal. I know this is a blunt tool and gives no leeway for recordings made with the best of intentions such as those for which you are making your request. However (if you are still with me !) there is a glimmer of hope. There is an article:

It argues for a revision of the law to allow freedom to do what we are talking about..I've tried to do that fancy hyperlinking highlighting thing that takes you the page directly but I'm afraid I'm not that technically minded.

I got a bootleg Teada tape recording, but I asked Teada if I could. And they said yes. Is that allowed?

Always ask permission ! I've only had a few refusals at Celtic Music Festivals. Most performers like to see the videos that I make of them on the YouTube or MySpace. I usually put them
on http://www.youtube.com/b0dhran Some have been linked
to the various bands web sties, some have been echoed by Celtic Radio (Internet Radio).

It's free publicity - most band leaders know that it will help
sell CD's and are happy to accomodate the videographer,
Just ask and you will probably get a better video angle, too!
