New band has snatched my username

Rip-the-calico which I snatched from a tune title is now being used by a band who are doing the irish circuit in the south east. I approached them about this at a gig in Maidenhead and got a 4 letter tirade of "compliments" about how nice it was of me to plug their bands name across the web for free. When are my royalty cheques going to arrive is what I am asking myself ? So here it goes a full plug for this band who's name I share

They were like a cross between early stocktons wing with instruments being flute, fiddle, box, bodhran, guitar and banjo and the pogues with the less haste more speed style of playing. The songs were foot stomping crowd pleasers too. But they need to dress a little less smart and grow more hair if they want to immitate the dubliners from a visual aspect.

If there are any members of this group who are members here to just e-mail me your visa, switch, delta numbers and I can take care of the rest ;-)

And when are you going to start sending money to the family of the person that wrote "rip the calico"? i lovely tune which i learnt in ennis at the trad festival. i was the only piping student in the class, so i got a special reward for being top of the class!

Are you actually being serious here?

i think if they want to immitate the dubliners a bit more, then surely they should invest some serious money into guinness ltd and grow some massive beer guts, oh and i take it they are all well into their fifties?

er, flanum, you should read RTC's post a little more carefully, maybe even between the lines... uh, unless you're just messin around too and and sucked me in, making me twice the fool.

Great Dubliners segment on that "Come West Along the Road" DVD. Looked like they were wearing Lon Chaney wolfman makeup.

I hate to ruin yer day but there'sgood band called RipTheCalico up in The Wirral (Merseyside)... It really is better to come up with an original name for a band..

Now our bands name wasn't as, many people think, related to anything to do with music.... It just so happens that at the time we were looking to name the band we noticed that our guitar player, who has a very weak bladder, kept shooting off to the pan mid tune...!

We decided that "The Catheters" or The 'ncontinence nickers" didn't quite have that Irish ring to it not to mention that people may may have thought we were taking the p... hence the WeeBagBand...!

Just you try coming up with an original band name, then......tune titles are always a start, but Roaring Jelly was my favourite.
I came up with a good band name as I thought, turns out there's a Canadian band similarly called, but they don't play barn dances so unlikely to cause too much confusion.
There was always the Farley-Welwyn-Dowd Band....
If you want to copywrite a name, just go ahead,it can complicate as well as confuse - Englebert Humperdinck was always just Englebert in Germany, as there already was an E. H...
And then there's the copywriting of original traditional material; a whole other kettle of fish there too.

Mr Flanum I am being anything but serious I dont give 2 hoots about names its all about the substance at the end of the day. There are some bands that have a great name and they use great graphic art advertising and on paper it looks convincing but when you get there you cant help but think wow that was a load of over hyped s**te does anyone remember "Dance to Tipperary" and all the stossy colourful c.d.'s etc classic example. I understand where the term Ripthe.... comes from and thats more important to me.

You could always try "Lead Balloon" too !

It may be annoying, but there is nothing you can do about it legally, at least in US. Titles/names are not covered under copyright law for one, and in fact while looking for a name for our trio, we originally thought of Banish Misfortune... thankfully I thought to do web searches on each name ahead, and found at least five bands with that name in different areas.

Under US copyright law at least you can't copyright a name. that's why you will occasionally see two books with the same title.

If they are using it to harass you and make you look bad and such i suppose you can try to sue them but it would likely get nowhere at all.

Are you sure it wasn't just coincidence? I imagine if a rock band decided to use the name Rolling Stones, and were booking themselves all over pretending to be the real ones, and people would only find out after buying a ticket, that could be a legal issue, but a smallish trad band having the same name as another is not uncommon. I looked at other names too that had been in use by multiple bands, it was a real eye-opener. So many....... a simple Google search will stop these problems.

You could try for a cease and desist on the use of the name, but unless you have the band set up as a business, accounts in that name, registration with the county or state or whatever etc. pay income tax in that name as a business, it is unlikely you'd get anywhere. You'd just likely waste a lot of lawyer fees.

One can, however, register a name for certain things, enterprises, and so on, as a "trademark" in the US, but it's an expensive and complex process, and it only provides limited protection against other uses of the name.

Most law-folk advise that it's only effective at the highest levels of corporate business. They seem to think that unless there are truly zillions of money at stake, or product liability issues, that any common use of a term is 'free publicity'...

Ah, those upstart Canadians....perfectly able guys'n'gal, but they write their own stuff, and I prefer the traditional mainly.
